Abstract
This study aims to determine the causes of human rights abuses against Indonesian migrant workers as well as its protection efforts, this research also aims to determine the enforcement of human rights obligations and the extent to which implementing the placement of Indonesian workers abroad carry out its responsibilities. This research is based on the study of juridical normative literature with primary data source used is the Universal Declaration of Human Rights, December 1948, Law no. 39 year 2004 regarding the placement and protection of Indonesian workers abroad as well as several human rights conventions concerning other. Furthermore, secondary legal materials used in this paper include books, scientific articles, online journals and tertiary legal materials such as dictionaries and dictionaries of law and other legal source material.
The results showed that the formal judicial, human rights have actually secured, but at the level of implementation of these rights have not been fully operationalized and socialized. Oppression and abuse against Indonesian migrant workers is a fact which shows that these rights are not owned by them. Factors that lead to human rights abuses against Indonesian migrant workers abroad, among others, namely the placement of Indonesian nationals to work abroad by individuals through illegal procedures, where the recruitment of job seekers Indonesia does not meet the applicable requirements, including Indonesia puts workers who do not pass the competency test work.
