Abstract
This study aims to analyze how the labor agreement that's been made by the parties set a limitatif about the rights and obligations, especially for those who are engaged in marine work contract. This study uses normative research methods. The data obtained and analyzed using theoretical basis. Both the data that originates on the primary data such as the Book of Law Civil Law (Civil Code), Book of the Law of Commercial Law (Code of Commerce), and Law Number 17 Year 2008 About Sailing Sea and secondary data such as jurisprudence, the Treaty was analyzed by using a normative juridical analysis of the study on legal norms, legal principles of a regulatory, legal systematics of the hierarchy of laws and the synchronization of material. The results showed that the benefits and allowances sailing safety is often neglected by companies merge between wages and benefits as well. This is very detrimental to the workers at sea, especially ABK, wages and allowances due to uncertainty. The importance of sailing allowance provided for in sailing-related risk of occupational safety is very high but it is also in order to master and the parties on board must be careful, thorough and full responsibility of running the task.
