Abstract

There is a principle of law in Peppres. 54 of 2010 and the principles of common law in public law and private law are issues that are critical to consider in the BOT contract is a principle of justice in the agreement. But in reality, this principle has not been regulated in Peppres Number 54 Year 2010 and other regulations related to the BOT Agreement. Justice in the BOT Agreement is a condition in which both parties are in a balanced position or proportional. BOT Agreement as an agreement that in the realm of public and private law is directly involved only the government and private treaty, but basically involves also people in its implementation so that the BOT contract is an agreement that gives justice to the parties and to the people.
